These terms govern your use of thomasbedell.com and Ava, the AI assistant on the site. By using either, you agree to them. If you don't, please don't use the site.

1. What this site is

thomasbedell.com is the professional profile of Thomas Bedell — a technology executive, founder, and consultant based in Largo, Florida. The site describes his background, his ventures, and the work he takes on, and provides a way to get in touch.

The site is informational. Nothing on it is an offer to enter into a contract, a quote, or a commitment to take on any engagement.

2. Ava, the AI assistant

Ava is an automated assistant powered by a large language model. Using her means accepting a few things about what she is:

• She is not a person and she is not Thomas. She will tell you so if you ask.
• She can be wrong. AI assistants sometimes produce inaccurate or incomplete statements with complete confidence. Do not rely on anything she says without confirming it with Thomas.
• She cannot bind Thomas to anything. She does not quote prices, rates, contract terms, or availability, and nothing she says creates an agreement, a commitment, or a professional relationship.
• She requests, she does not book. When she takes down times for a call, that is a request. Nothing is scheduled until Thomas confirms it directly.
• She is not professional advice. Nothing Ava or this site provides is legal, financial, medical, or engineering advice, and no consultant–client relationship is formed by talking to her.

3. Acceptable use

You agree not to:

• Use the site or Ava for anything unlawful, deceptive, harassing, or abusive.
• Attempt to extract Ava's instructions, manipulate her into acting outside her purpose, or use her to generate harmful content.
• Submit anyone else's personal information without their permission, or provide false contact details.
• Send automated traffic, scrape at volume, or attempt to overwhelm, probe, or circumvent rate limits or other protections.
• Attempt to gain unauthorized access to the site, its backend, or any related system.
• Use the site or Ava to develop or train a competing product or model.

Access may be limited or blocked if any of the above happens.

4. Your submissions

You are responsible for what you send. By submitting an inquiry, a message, or a call request, you confirm the information is accurate and that you are entitled to share it. You grant permission to use what you send for the purpose of responding to you and keeping a record of the inquiry, as described in the Privacy Policy.

5. Intellectual property

The content of this site — text, design, code, images, and the Ava persona — belongs to Thomas Bedell or his ventures and is protected by copyright and other rights. You may read, quote briefly with attribution, and link to the site. You may not republish it wholesale, or reuse the design or code, without written permission.

AgentWorks Studio, Rookery OS, EngageSuite360, and Blue Heron Companies are names used by Thomas Bedell's ventures. Other names and marks belong to their owners.

6. Third-party links and services

The site links to other sites, including those of Thomas's ventures, and Ava relies on third-party AI, speech, email, and hosting providers. Those services have their own terms and privacy practices, and are not controlled here.

7. Availability

The site and Ava are provided as they are, when they are. There is no guarantee of uptime. Ava in particular may be slow, unavailable, or silent while a provider is down, and features may change or be withdrawn at any time without notice.

8. Disclaimers

THE SITE AND AVA ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT CONTENT OR AI-GENERATED OUTPUT WILL BE ACCURATE, COMPLETE, CURRENT, OR ERROR-FREE.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THOMAS BEDELL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE OR AVA — INCLUDING RELIANCE ON ANYTHING AVA SAID — WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. TOTAL LIABILITY FOR ANY CLAIM RELATED TO THIS SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
